Terms and conditions for group sales
VarVacations.com/VoyagesARabais.com is a trade mark and is operated by the company 9129-2367 Quebec Inc, moral person, established under the Companies Act of Quebec. (VarVacations.com/VoyagesARabais.com hereafter named the travel agency chosen by the web client ).

Making a reservation confirms your understanding and acceptance of the general conditions listed below.
Purchase of packages/tours (hereafter called the « services » offered by VarVacations.com/VoyagesARabais.com consists of a contractual agreement between VarVacations.com/VoyagesARabais.com (VAR) and the client and implies his acceptance of the VAR sales conditions described hereafter.

FOR ALL SERVICES
These sales conditions are applicable to all packages/tours and cruise packages.

INDICATED PRICES INCLUDE
Benefits related to reserved services described on our website such as: return flights in economic class departing from Montreal, transfers, lodging or cabin according to chosen category, specifically mentionned meals and drinks, hotel and service fees unless otherwise noted, specifically mentionned visits and activities, services of a local guide during visits and excursion, serivce of an accompanying person if applicable, compensation fund for customers of travel agents of Quebec (0,35 %, example, 3,50 $ for each 1000,00 $), T.P.S., provincial sales tax when applicable and all of the discounts.
Total cost of ordered services includes airport taxes and service fees.

PRICES DO NOT INCLUDE
Personal expenses such as passport, travel insurance, tips, telephone, laundry, but also meals, drinks, visits and activities that are not specifically mentionned as being part of the package/circuit, and optional excursions.

PACKAGE DESCRIPTION
All of our packages are described on our website at http://www.varvacations.com. We have done our best to ensure that the descriptions are exact at the moment of the documents' publication. Although updates are made regularly, modifications of services that are beyond the control of VAR can occur without notice. The staff will do everything to minimise the effects of these changes and inform passengers within a reasonable delay.
The functionning of the itinerary, the order of the scheduled visits as well as the indicated schedules can be modified according to the circumstances, unpredicted situations and conditions that occur on-site (weather, important traffic of tourists on certain sites, etc). Airline companies, hotels, forms of transport and other benefits can be subject to change if unpredicted circumstances, security, local authorities or other conditions request it.
Hotel names, photos and plans that are mentioned in the tours are given as a reference only.

CANCELLATION FEES
In order to better determine the cancellation delay, the departure day will be excluded. Any cancellation must be confirmed in writting at groupes@voyagesarabais.com. Cancellation fees will apply if the passenger cancels his reservation. At more than 75 days before departure, the deposit is non-refundable. At less than 75 days before departure, reservation is 100 % non-refundable. After the passenger has left the departure point, no refund will be made for unused or cancelled services.
Due to global politics, cancellation fees are applicable even in case of a cancellation or cancellation request caused by a war (whether declared or not), armed conflict, insurgency, terrorism, etc. even in the visited region or country. Traveller renounces to invoke such motives or apprehension of them to justify a cancellation and therefore ask for a refund after the reservation.

MODIFICATION FEES
More than 75 days ahead of the departure, all modifications made to a reservation by the client are subject to a fee of 50 $ per change. Less than 75 days before departure, no modification is possible.
At the time of booking, the passenger must give the same name that appears on his Canadian passport. If the passenger has a foreign passport, the information needs to be specified at the time of booking. Fees will be charged if an incorrect name was given to VAR (name at the time of booking versus name on passport), this being considered as a cancellation.

HOW TO RESERVE / FINAL PAYMENT
A deposit of 500,00 $ will be requested at the time of booking. Final payment must be made 75 days before departure. Failure to receive payment will result of an automatic cancellation of the package and the loss of deposit. Reservations made less than 75 days before the departure date will need to be payed in full at the time of booking. All deposits are non-refundable. If an upaid file goes to our collection agency, fees of 35 % will be added to the due amounts.

INDICATED PRICES
Unless otherwise specified, listed prices are per person in Canadian dollars.
In accordance with the law, price of the contract can be modified if there is a taxation or a tax increase enforced by the local government authority, a fuel surcharge or a higher exchange rate. In such a case, if the modification is caused by a fuel surcharge or a higher exchange rate and leads to a price increase of less than 7 % exluding T.P.S and T.V.Q., client agrees to pay the difference. However, if the modification leads to an increase of a price equal or superior to 7 % of the price, excluding T.P.S. and T.V.Q., client will then be able to choose between (1) cancellation of the contract and total price refund or (2) acceptance of replacement services that could be offered. No price modification can be made fewer than 30 days before departure.
VAR has the right to refuse a reservation that has been made at an erroneous price.

LODGING
Only hotel owners are responsible for room allocation. Cruise companies are also responsible for cabin allocation according to the reserved category. All special requests, even if they are submitted at the time of booking, are not guaranteed. Modifications can be made on-site as long as there is availability and that the passenger pays the fee difference applied by the hotel owners.
Quality standards described in the brochure and on our website are established according to criteria and quality standards specific to the country where the hotel is located, and may differ from North American standards.
Usually, hotels require that clients move into their rooms between noon and 3:00 PM and vacate their rooms at noon on the day of departure.

SERVICE MODIFICATIONS
If certain services are no longer available before departure or at the destination arrival, VAR has the right to cancel them or to replace those services by equivalent or superior substitutions.
In the case of a cancellation, VAR's responsibility will be limited to refunding amounts payed by the clients for the concerned services.

LUGGAGE
VARvacations accepts no responsibility for loss or theft of luggage. Passengers should consult the airline company's website in order to understand luggage restrictions.

CREDIT CARD
The credit card holder must be one of the passengers who will benefit from the ordered services. The use of a credit card that does not belong to one of the passengers will be treated differently. In allowing the use of his credit card number, the client commits to respect the reservation conditions even if he did not sign the appropriate document. The credit card holder who gave his credit card information is responsible to pay for all of the passengers appearing on the file. VAR has the right to make a verification of the information provided by the credit card holder.

CARRIERS
Client aknowledges and accepts the following :
VAR is not a carrier. Transportation offered is made in accordance with the different organisations' regulations managing air and land transport.
The transport conditions are subject to the stipulated clauses to the transfer voucher and to Government Regulations. Seats in the plane are assigned at the airport by the airline company's counter agent. It is the client's responsibility to meet the representative at the agreed rendezvous point at the scheduled time. Your presence at the check-in counter is required at leat 3 hours before departure time. You should have with you the necessary documents you will need to travel such as passport, plane and hotel tickets. If you are missing documents, you could lose your reservations and your seats could be reassigned to other travellers, and you would have no recourse to VAR.
In any circumstances VAR will be held responsible for loss or damage resulted by a flight, maritime or land transportation delay. VAR is also not responsible for any accident, event or delay occuring when a passenger is at the airport, on board of a plane, maritime or land transportation device. VAR has no control over the carriers, departure time or any other supplier benefits.

BOARDING
Client aknowledges and accepts the following :
Verification of times : It is the passenger's responsibility to confirm his flight schedule directly with the airport 24 hours before the scheduled departure time by visiting www.admtl.com or contacting 1-800-465-1213 in order to ensure that there is no change.
Flight schedules, aircraft types and stops along the flight paths are given for reference only and are subject to change without notice.
Registration at boarding : VAR recommends that customers arrive at least 3 hours prior to departure at the airport with the essential documents such as passport, plane and hotel tickets.
VAR has the right to refuse or expel from a group any individual who is found in a state that hinders the smooth functioning of activities or has an unacceptable behavior making the continuation of the trip difficult (insalubrity, alcohol intoxication, etc). In such a situation, no refund nor compensation (in part or in full) will be granted. Also, all expenses incurred following a refusal to board or group expulsion will be at the client's own expense.

TRAVEL INSURANCE
VAR strongly recommends that its clientele subscribe to a complete travel insurance policy that is adapted to the passenger's different needs. If the client does not purchase travel insurance, he understands that his coverage will be managed by la Régie de l'assurance maladie du Québec (RAMQ) or by a personal insurance.

VALIDITY OF DOCUMENTS
Documents are nominative and are not transferable. Portions of unused ordered services are not in any circumstance refundable, usable or endorsable on a later date.

TRAVEL DOCUMENTS
It is your responsibility to have with you all travel documents, passports, visas as well as all vaccinations required by regulating authorities in the country you will be travelling to and this, at your own expense. A passport valid until at least 6 months following your return date can be requested.
A traveller who does not have the necessary travel documents for the trip may be refused access to board or entrance in the country of the final destination. In such case, VAR cannot be held responsible. At no time VAR or one of its representants will be held responsible if a traveller does not have the necessary documents to undertake a trip that has been reserved with the company.

NOTICE TO CLIENTS
Some inconvenience may occur during a trip. The client is aware this can happen, must assume the consequences and understands that VAR cannot be held responsible. Notably the following elements:
Living Standard : Outside Canada, the living standard, local customs, religion, political system and available services may differ from what the client is used to in Canada. Also, certain services can be interrupted or unavailable during the client's stay. The client is responsible for his own health and must take all necessary precautions to avoid or limit any illness or inconvenience related to their health. Having no control over these circumstances, VAR is therefore not responsible for damage, inconvenience or loss of enjoyment.
It is the travellers' responsibility to inform themselves of the destination country they will be visiting. Foreign Affairs and International Trade Canada's website (www.voyage.gc.ca) can be a useful tool.
Roads, construction, road circulation : Client is aware that VAR is not responsible for unforeseen delays that can unfortunately affect tours, activites, or free time without them being rescheduled.
Holidays, school breaks, elections and conventions : Some inconvenience and/or interruptions and/or delays can occur during special occasions and can therefore affect some tours and activities without them being rescheduled . The customer understands that VAR is not responsible for this.

FORCE MAJEURE
VAR is not responsible for any breach in the execution of its obligations including all loss or damage resulting in a delay, cancellation, loss of assets, illness, injury, accident, mortality, weather conditions, deterioration in the quality of services, inconvenience, loss of enjoyment, disappointment or frustration (physical or mental), resulting from the following events:
Fortuitous events, force majeure or third party action : War, revolution, riot, embargo, terrorism or any other illegal act committed against public order, "Act of God", accident or failures related to aircraft, coaches or any related equipment, strike, lock-out or any other problem related to third party employees, VAR employees or any other factor uncontrolled by VAR.

EXCLUSION FROM LIABILITY
Although VAR carefully selects its suppliers (carriers, hotels, representatives, local guides, receptives and others), VAR has no control over them and cannot be held responsible for their acts, omissions, mistakes and/or neglect. Services are also subject to the supplier's general conditions.
VAR has the right to modify or cancel a trip if they have reason to believe that customers' security is threatened.

COMMENTS AND CLAIMS
For any problem at the arrival destination, the client must immediately warn a member of VAR in order to enable a quick resolution of the problem. In case of an unresolved problem on-site, the client has 30 days following his return to send a written report of the problem, and this to the attention of relationsclientele@voyagesarabais.com.
